1. Privacy Your information will be used to provide you with updates that may affect our service provision and/or access to facilities. This includes class cancellations, changes to operations, membership correspondence, etc. You may choose to opt out with staff once the membership enrolment is complete. By choosing to opt out of all correspondence, you agree and acknowledge that you will not receive important communications, updates or notices. You are agreeing to treat staff with respect and understand that your decision to opt out may result in being unaware of changes that directly affect you. 2. Age Limits Swimming Pools: Children under 13 years of age must be supervised by a responsible adult. Spa, Sauna and Steam Room: 16 years and over Health Club: 15 years and over Aerobics and Aqua aerobics: 13 years and over (15 years and over for any weight resistance classes) Hydrotherapy: 16 years and over (except for approved programs) Memberships for minors (under the age of 18) require proof of age and legal guardian authorisation. 3. Membership Fees and Charges Monthly direct debit fees are subject to change as per the City of Bayswater Fees and Charges. Members will be notified of any approved changes to fees prior to changes being implemented. To be eligible for concession pricing, members must provide evidence of any concession cards detailed in section 7 of these Terms and Conditions. 4. Direct Debit Memberships - Direct Debit Memberships are only available on an Ongoing No Lock in agreement. - All direct debit payments for memberships are taken on our behalf by EziDebit. The member agrees to make all payments due and agrees to the associated costs charged by EziDebit. Cancelling a payment method or placing a stop on direct debits will still incur the agreed membership fees which are required to be paid until 30 days cancellation notice is received by the facility. - EziDebit fees - $2.20 one-off fee with the first direct debit. $14.80 fee for any failed direct debit payment. The facility cannot reduce or remove these fees. - 30 days written notice is required to cancel the membership. Any scheduled payment that falls into this 30 day period will be debited as normal before the membership closes. Suspensions and missed payments will delay cancellation. 5. Suspensions Memberships can be suspended. Fees apply and suspensions cannot exceed 50% of the total membership term. Suspensions and changes to existing suspensions must be requested in writing with a minimum of 24 hours notice. - The suspension fee may be waived at the facility's discretion with a current and valid medical certificate outlining dates and the reason why the member cannot attend the facility for this period. - During suspension periods, usage of the facility is not permitted. - The backdating of suspensions is not permitted. 6. Replacement Access Fobs The first membership fob you are given is complimentary. Subsequent membership fobs are $6 to replace. 7. Applicable Discounts Concessions are provided for the following cards: - A current Pensioner or State Concession Card - A current Seniors Card - A current Student Card - A current Health Care Card (Government Issued) - Companion Card Discounts are provided for DVA. Valid evidence of eligibility must be provided to receive concession rates. 8. Change of Details - It is the responsibility of the member to advise the facility of any changes in personal details. - Direct Debit members must complete a "Direct Debit Variation Form" if personal or bank account details change. - Fees apply for failed debits arising from incorrect information. 9. Membership Access - Entry to the facility may be refused without a valid membership pass. - Access fobs are to be used to gain access to the facility programs and services. - Unauthorised use of membership access will result in immediate suspension and potential cancellation. - Management of the facility may refuse entry or request any person to leave the premises if the person breaches the Member Code of Conduct or Conditions of Entry. - All members agree to abide by these Terms and Conditions. Failure to do so will result in a first and final warning letter. Further indiscretions that contravene the terms and conditions will result in immediate termination of the membership. In these instances, no refunds will be given. 10. Membership Cancellations and Refunds - Memberships can be cancelled via written notice and completion of a Membership Cancellation Form - Further information may be requested by facility staff upon initial cancellation notification. Cancellations will not be processed until the requested information is provided. - Cancellations are subject to a 30-day notice period for both direct debit and upfront memberships. Permanent Illness or Incapacity - In this situation, membership can be cancelled with the 30 day notice period waived. Evidence must be provided in the form of a current and valid medical certificate and must state that the member has a "Permanent Illness or Incapacity". 11. Conditions of Entry - Code of Conduct must be followed at all times - A towel must be used in the gym - Closed in footwear must be worn in the gym - Appropriate clothing must be worn at all times - Child Supervision in nonnegotiable in line with our Age Policy (Section 2) - Health Suite Wristbands must be worn at all times in the Health Suite - Moving facility equipment is strictly prohibited - Some services have additional fees Recreation and facility program and service information can be found on the City of Bayswater Recreation website - https://bayswaterrecreation.com.au/
